The Case Against Smoking Bans

Thomas A. Lambert, associate professor of law at the University of Missouri School of Law, wrote a great article The Case Against Smoking Bans that was published in the Cato Institute’s Regulation Magazine.

Lambert’s article covers all the angles of the smoking ban issue very well (including the public misrepresentation of studies on passive smoke), except one: The junk science and myth of the risk of second hand smoke referred to as Environmental Tobacco Smoke (ETS). All the ‘studies’ on ETS, regardless of their results, are actual junk science. They’re based on retrospective questionnaires about vague memories of exposure, and they are plagued with seriously flawed methodology. Richard White, in his comprehensive book, Smoke Screens: The Truth About Tobacco, exposes these ‘studies’ for the junk they really are. The book analyses the scientific ‘evidence’ linking tobacco smoking to disease and premature death, as well as the political motivations that have led to the anti-smoking movement becoming so large. It challenges the most widely accepted beliefs of our time.

The worst part of these flawed ‘studies’ is that they have been, and continue to be, used by authorities as a basis to form public policy. The establishment of those policies by special interest groups that together with the authorities, initiate hatred and intolerance between social groups is a crime even greater than the fraud itself.

Dr. Terry Simpson M.D. in his article, The Myth of Second Hand Smoke (ETS), deals well with the issue of the junk science and debunking the myth that there thousands of people developed tumors or heart disease as a result of second-hand smoke.

    Great Post! The zealots are using junk science in their attempt to limit cigar smoking by adults. Unfortunately the worst offenders are the so-called reformed smokers. Just look at our Commander-in-Chief. Obama sign into law the largest cigar tax increase in the history of the United States.

    I am a cigar smoker (at least one a day), but I believe that we as smokers do not have the right to pollute the air that others are forced to breathe, as in restaurants and bars.
